1. Acceptance of Terms

1.1. Agreement: By accessing or using Telozar (the “Platform”), owned and operated by Ametecs India Private Limited (“Ametecs India,” “we,” or “us”), you (“User,” “TelePro,” or “Advertiser”) acknowledge you have read, understood, and agree to be bound by these Terms & Conditions.1.2. Eligibility: You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use Telozar.

2. Definitions

  • “Advertiser”: A registered user who posts or funds telemarketing campaigns.
  • “TelePro”: A registered user offering telemarketing or related services (lead generation, sales, etc.).
  • “Services”: The functionality, tools, and features provided by Telozar, including optional telephony resources and escrow-based payment.

3. User Accounts & Registration

3.1. Account Creation: Users must provide accurate and complete information during registration. Any false or misleading details may result in suspension or termination.3.2. KYC Verification: We may require digital or physical identity verification (e.g., Aadhaar, government-issued ID) to ensure the authenticity of Users.3.3. Security: You are responsible for keeping your login credentials confidential and must notify Telozar immediately of any unauthorized access.

4. Platform Usage & Obligations

4.1. Compliance with Laws: Users agree to abide by all applicable laws, regulations, and do-not-call registries when engaging in telemarketing activities.4.2. Prohibited Conduct: Users shall not engage in spam, harassment, fraudulent practices, or any unlawful activities. Violations may lead to immediate account termination.4.3. Accuracy of Campaign Information: Advertisers must provide truthful campaign details (scripts, target audience) and are solely responsible for the content.4.4. Quality Assurance: Telozar may conduct random checks (e.g., call recordings, lead validations) to ensure compliance and quality.

5. Payment & Escrow

5.1. Escrow Deposits: Advertisers must deposit campaign funds into Telozar’s escrow system. These funds remain on hold until deliverables (calls, leads, sales) are verified.5.2. TelePro Payouts: Upon successful completion of milestones or final verification, Telozar will release the corresponding escrow amount to the TelePro.5.3. Platform Fees: Telozar may charge fees or commissions for services, which will be disclosed during campaign setup or in your user dashboard.5.4. Chargebacks & Refunds: If deliverables are disputed, Telozar’s Dispute Resolution procedure will apply. Funds may be withheld or refunded based on our investigation.

6. Intellectual Property & Confidentiality

6.1. Platform IP: Telozar, its logo, and all related designs are the exclusive property of Ametecs India. Users may not copy, distribute, or create derivative works of any platform content without explicit permission.6.2. User Content: Campaign scripts, brand assets, or data provided by Advertisers remain their property. TelePros agree to use such assets solely for the agreed campaign.6.3. Confidentiality: TelePros and Advertisers shall protect each other’s confidential information and not disclose it to third parties without permission.

7. Dispute Resolution

7.1. Initial Negotiation: Advertisers and TelePros should first attempt to resolve issues through direct communication within the Platform’s messaging system.7.2. Escalation to Telozar: If unresolved, either party may escalate to Telozar’s Dispute Resolution team, which will review evidence (e.g., call logs, lead submissions).7.3. Binding Decision: Telozar’s resolution is final and may include partial refunds, payment release, or other actions (e.g., account suspension).

8. Disclaimer & Limitation of Liability

8.1. Disclaimer: Telozar is a marketplace connecting Advertisers and TelePros. We do not guarantee the success, legality, or quality of any telemarketing campaign.8.2. Indirect Damages: To the fullest extent permitted by law, Telozar shall not be liable for indirect, consequential, or incidental damages arising out of platform use.8.3. Total Liability: Telozar’s total aggregate liability is limited to the fees collected from the campaign in dispute.

9. Termination & Suspension

9.1. Voluntary Termination: Users may close their accounts at any time, provided there are no ongoing disputes or outstanding financial obligations.9.2. Breach of Terms: We may suspend or terminate accounts found violating these Terms or engaging in suspicious activity without prior notice.9.3. Survival: Provisions regarding confidentiality, limitation of liability, and dispute resolution survive termination.

10. Modifications to Terms

10.1. Updates: Telozar reserves the right to modify these Terms at any time. We will notify Users of significant changes via email or Platform notices.10.2. Continued Use: Ongoing use of the Platform after modifications indicates acceptance of the revised Terms.

11. Governing Law & Jurisdiction

11.1. Legal Framework: These Terms shall be governed by the laws of [Applicable Country/State], without regard to conflict-of-law principles.11.2. Venue: Any disputes shall be filed in the courts having jurisdiction over [City, State/Country], unless otherwise specified by local law.
